Odessa College supports the free exchange of ideas including the freedom of speech. The college upholds the First Amendment to the United States’ Constitution: 

“Congress make no law respecting an establishment of religion or prohibiting its free exercise. It protectsfreedom of speech, the press, assembly, and the right to petition the Government for a redress of grievances.”

In compliance with the recently enacted Texas law (Senate Bill 2972, also known as the Campus Protection Act), Odessa College is implementing changes to its expressive activity policies beginning September 1, 2025, as required for the 2025–2026 academic year.

Key Updates

  1. Designated Public Forum
    Only areas formally designated by the college are considered public forums. The previous approach, which recognized all outdoor common areas as public forums, has been revoked.
  2. Eligibility to Engage in Expressive Activity
    Only students and employees of Odessa College may conduct expressive activities on campus. Members of the public must submit a written request to studentactivities@odessa.edu at least 72 hours before the event to be considered for participation. Submitting a request does not guarantee approval. Approval must be granted before conducting the event.
  3. Time Restrictions
    Expressive activities are prohibited between 10 p.m. and 8 a.m.
  4. Final Two Weeks of the Semester
    Activities—including amplified sound, speaker events, or percussive instruments—that materially disrupt campus operations are banned during the last two weeks of the semester.
  5. Prohibited Activities
    The law bans specific forms of expression, including:
    • Erecting tents or encampments
    • Wearing disguises or masks intended to conceal identity
    • Lowering the U.S. or Texas flag to raise another nation’s or organization’s flag
  6. Identification Requirement
    Students and employees participating in expressive activities may be required to present valid Odessa College identification upon request.

Designated Expression Zone

To align with SB 2972, Odessa College has designated the Rudy Acosta Pavilion as the official public forum zone for expressive activity:

  • During the academic year (when classes are in session): Monday–Friday, 4 p.m. to 6 p.m.
  • When school is not in session: Monday–Friday, 12 p.m. to 6 p.m.

All expressive activities must take place in this area during the designated hours unless prior written approval is obtained. Activities—including amplified sound, speaker events, or percussive instruments—that materially disrupt campus operations are banned during the last two weeks of the semester.

Odessa College remains committed to supporting a safe and respectful environment for dialogue and expression while complying with state law. These updated guidelines ensure that expressive activities can continue in a way that supports the college’s mission and maintains a safe, orderly campus for all.

The Executive Director of Student Life or designee will monitor free speech events or demonstrations that take place in common outdoor areas in coordination with the Odessa College Police Department (OCPD).
